- These Terms & Conditions govern the services provided by New Forest Wills (“we,” “us,” “our”) to our clients (“you,” “your”).
- By engaging our services, you agree to these terms. If you do not accept these terms, please do not use our services.

We provide the following paralegal services:
Will Writing – Preparation of legally valid wills based on client instructions.
Probate Assistance – Non-contentious probate support (where permitted under UK law).
Power of Attorney – Drafting and guidance for Lasting Power of Attorney (LPA).
Trust Services – Advice and drafting for basic trust structures within a will.
2.1. Unreserved Legal Activities
- Will writing, power of attorney, and trusts are unreserved legal activities, meaning they can be carried out by trained professionals without solicitor oversight.
- We do not offer legal representation in court or reserved legal activities requiring a regulated solicitor, such as contentious probate matters.
2.2. Reserved Legal Activities
- We only involve an associate solicitor for reserved legal activities, including probate when necessary.
3. Client Responsibilities
To ensure accurate and legally valid documents, you agree to:
- Provide complete and truthful information regarding your estate, assets, and beneficiaries.
- Confirm the accuracy of your will or legal documents before finalising.
- Arrange for appropriate witnesses when signing your will (we provide guidance).
- Notify us of any required changes before document submission.
4. Fees & Payment Terms
- Pricing for services will be agreed upon before work begins.
- Full payment is required before the finalisation of your documents.
- Accepted Payment Methods: Bank transfer, credit/debit card (if applicable).
- No refunds will be issued once a document has been drafted and validated.
5. Limitations of Liability
- We prepare wills and legal documents based on the information you provide. We are not responsible for errors or omissions caused by incomplete or inaccurate details.
- We are not liable for any disputes, challenges, or legal consequences resulting from your will after execution.
- We do not provide tax or financial advice but can refer you to a qualified professional if required.
6. Will Storage & Future Updates
- We do not retain physical copies of your will unless otherwise agreed.
- It is your responsibility to store the will securely and update it as needed.
- If you require updates, we can assist in drafting a new will (charges apply).
7. Confidentiality & Data Protection
- We handle your personal data in compliance with UK GDPR and the Data Protection Act 2018.
- All information you provide is strictly confidential and used only for legal service purposes.

8. Third-Party Disclaimer
- We work with a third-party will drafting and validation business to ensure all documents meet legal standards.
- This third party is responsible for drafting, reviewing, and validating wills based on the instruction document we prepare with you.
- Any relevant insurance coverage is provided by the third party, not New Forest Wills.
- We are not responsible for any errors, omissions, or liabilities arising from third-party drafting and validation processes.
9. Cancellation Policy
- If you cancel before we begin work, no charges apply.
- If work has commenced, a partial refund may be issued at our discretion.
- No refunds will be provided for completed documents.
10. Governing Law & Dispute Resolution
- These Terms & Conditions are governed by the laws of England and Wales.
- Any disputes will first be addressed through negotiation. If unresolved, disputes may be referred to an alternative dispute resolution (ADR) provider before legal action is considered.
11. Changes to These Terms
- We may update these Terms & Conditions from time to time.
- Any changes will be posted on our website with the effective date clearly stated.
